Nichole M. Valeyko

Nichole M. Valeyko assists clients in trials before the USPTO's Patent Trial and Appeal Board (PTAB) and helps clients develop strong patent portfolios. She has helped clients obtain hundreds of U.S. and international patents and successfully assisted clients on case-dispositive litigation issues. Nichole uses her experiences in both patent litigation and procurement to help guide clients in obtaining patent protection.

Nichole’s services include patent prosecution, enforcement, IP due diligence, partnering agreements, freedom-to-operate assessments, and patent opinions, as well as counseling on portfolio strategy, and IP issues for start-ups. Her work spans a variety of technical areas including chemical, pharmaceutical, food science, medical device, and biotechnology.

After graduating law school, Nichole worked as an associate with a New Jersey area patent boutique where she prosecuted patent applications. During this, Nichole obtained her Masters in Biotechnology from Johns Hopkins University, where she focused her studies on both the scientific and business development aspects of biotechnology. Prior to joining Lerner David, she worked for a general practice law firm assisting start-up companies in various intellectual property matters. Nichole’s diverse experience provides her with valuable insights that assist clients in achieving their business and intellectual property goals.  

Nichole was recognized by New Jersey Super Lawyers Magazine in 2013 and 2014 as a Rising Star in Intellectual Property.
