David G. Leach

David Leach is a partner at Lerner, David, Littenberg, Krumholz, and Mentlik, LLP. His practice encompasses all aspects of intellectual property law.  This includes the initial acquisition of IP assets domestically and internationally, patent portfolio management, due diligence analysis of IP assets in the M&A context, freedom-to-operate studies for yet to be commercialized products, opinions of counsel, and IP litigation within the federal courts and the International Trade Commission (ITC).

While David has a mechanical background, he has helped clients obtain and protect intellectual property within a variety of technologies from the mechanical to the high tech.  Such technologies include orthopedic devices, heart valves and pumps, agricultural equipment and products, firearm components and accessories, non-fungible tokens (NFT's), semiconductor packaging, IoT devices and systems, and robotic surgical and diagnostic platforms.

David earned a Data Privacy Strategy Certificate from Cornell Johnson Graduate School of Management and is a member of the firm's Data Privacy and Cybersecurity Committee.   Specific data privacy and cybersecurity services we provide for our clients include due diligence and negotiation for M&A, privacy and cybersecurity policies and related agreements, CCPA/CPRA and GDPR Compliance, global data transfer management agreements, data processing and data transfer agreements, privacy statements for online activities, privacy and cybersecurity audits, privacy and data security breach preparedness, Employee training on privacy and security policies and proper data handling, privacy and data security litigation, responses and advice on responding to governmental investigations, privacy planning for data collection and management by IoT devices, of big data, and in cloud computing, and dispute resolution.

In a previous life, David worked as a design engineer designing mechanical and energy systems for healthcare facilities.  While attending The Ohio State University, David served an enlistment in the United States Marine Corps Reserve as an infantryman in 3rd Battalion, 25th Marine Regiment.  In 2005, his battalion was deployed to Al Anbar Province, Iraq where he participated in several major combat operations including daily counterinsurgency patrols and IED sweeps.

In David's free time, he enjoys going to the Jersey Shore with his family, shooting competitively and training Brazilian Jiu-Jitsu along with his 5-year-old son.

His practice encompasses all aspects of intellectual property law from procurement to enforcement, with a focus on freedom to operate and patentability investigations, clearance opinions, patent prosecution, and due diligence. Mr. Leach's experience has centered on medical device technology involving orthopedic and cardiovascular platforms with crossover into the semiconductor packaging, life sciences, and software industries. With this experience, David has developed a flexible approach to his practice that emphasizes risk management while adapting to each client's unique business strategies and objectives.
