He has particular expertise counseling clients in and litigating Abbreviated New Drug Application (ANDA) cases arising out of the complex intersection of the patent and FDA laws relating to the Hatch-Waxman amendments to the Federal Food, Drug & Cosmetic Act.
In addition to the life sciences, Van Buskirk has tackled matters arising within such industries as food and beverage, chemicals, cosmetics, consumer products, electronics, computer hardware and software, and telecommunications.
Lerner David Managing Partner, Bill Mentlik commends the depth and diversity of Van Buskirk’s background and experience. “Tedd’s demonstrated skills at identifying solutions are both savvy and cost effective, consistent with Lerner David’s business-focused approach to the practice of IP law,” Mentlik said.
Pointing to Van Buskirk’s long track record of success working with pharmaceutical clients, Mentlik continued, “With more than 20 years of experience litigating and counseling pharmaceutical clients on the blockbuster drugs of the past three decades, Tedd brings a wealth of experience to the firm. He has established himself as a go-to in the world of Hatch-Waxman for his ability to not only expertly navigate the legal and regulatory issues, but to understand how those issues affect each client’s business. He is a results-driven attorney in a results-driven industry.”
“I was drawn to the depth and breadth of talent at this renowned IP boutique,” Van Buskirk said of his new firm, “where I can continue working with the same great clients I’ve worked with for years, as well as assisting Lerner David’s existing clients, all while tapping in to the vast resources of the firm.”
In addition to his litigation practice, Van Buskirk is a registered patent attorney who prepares and prosecutes patent and trademark applications and has handled patent interferences, post grant proceedings, and trademark oppositions. He frequently delivers opinions on the scope, validity, and enforceability of patents. He also counsels established and emerging companies, venture capital and private equity firms, and underwriters in intellectual property licensing and transactional matters.
