New rules on “virtual patent marking” implemented by the America Invents Act have already taken effect:
• A product may now be marked with “pat.” or “patent” and reference to a freely-accessible Web address that identifies the patent numbers that cover that product.
• This will make patent marking easier, and allow inexpensive modification of patent markings when patent coverage changes or expires.
• As always, marking your products or providing actual notice are required for recovery of past damages for patent infringement.
